Terms & Conditions

 

1. Effect of this agreement

Viewing of the Canvas101.co.uk site itself is free; but when you purchase from the site, you agree to the terms of this agreement, and you re-affirm that agreement every time you use the Canvas101.co.uk services, so we recommend you read this agreement so you know what you're getting yourself into. In order to make a purchase or purchases from Canvas101 you will need to register an account with us. Registration takes less than 30 seconds and is absolutely FREE of charge. Your account details will not in any way be passed onto any third party or submitted on any email marketing lists.

 


 

2. Applicable law

Canvas101.co.uk is a trading name of Consortium101 Limited registered in England & Wales. Every sale shall be deemed to be performed in England; All card transaction will be completed online via our merchant bank account which is registered with Lloyds’s cardnet and all online purchases are processed by sage pay. For further information regarding the terms and condition of sage pay please visit their website at www.sagepay.co.uk
English law shall govern each transaction, including (without limitation) all contractual and other relationships, which arise as a result of such sales. You and we submit to the non-exclusive jurisdiction of the English courts in relation to any disputes arising out of any sale.

 


 

3. Engaging In a Contract with Canvas101

When making a transaction with Canvas101.co.uk, we ask that you agree to register for a Canvas101.co.uk user account using your correct name, address and any other requested details. You may be asked to enter credit, debit or charge card details. You must ensure that (a) you are fully entitled to use that card at the time when you provide those details to Canvas101.co.uk, and when you use the card it has available funds to cover all charges incurred on it in the course of buying from us. If any of the information you enter becomes incorrect or is superseded, then please notify us with the corrected information immediately. If you prefer to call us and make a payment over the phone, we also cater for this facility. Canvas101 does not store any card details on file neither are we able to view your card details as once a payment has been processed all details are removed from our merchant bank account.
In any event, to register for Canvas101.co.uk services, you must legally be able to enter into contracts for goods and services that you may buy here. Generally, this means that you must be at least 18 years old.

 


 

4 Tax & Duties

For purchases made to be delivered outside the European Union, you will automatically be responsible for paying all applicable duties if any apply. Canvas101 will not be held responsible for any customs duties which may be incurred when shipping outside of the UK. VAT will be charged on all goods at the standard rate (excluding gift voucher). Please note if you are a member of the European Union than VAT will be applicable and charged.

If you are ordering from with the EU and have a valid VAT registered number you can call our sales team who will be able to process your order with VAT exempt from your order. In order to equally for VAT exemption you must have a valid VAT number for the country you are ordering from.

All products shipped to the US, CANADA and any other country outside of the EU will be VAT exempt which is automatically calculated upon checkout.

 


 

5. Images / Frames / Corrections

Descriptions of goods and services included in the Canvas101.co.uk site are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them. However, you should know that the colours and appearance of images, mounts and frames may vary very slightly from the way they appear on the screen. Also print sizes can vary slightly with each production run. If you need to know the precise dimensions of a product, please contact us. If you require artwork in a customised size please contact the Canvas101 team and we will do our best to create it for you. All customisation are subject to reasonable requests.

 


 

6. Copyright

You accept that the images and designs used on the Canvas101.co.uk website are the property of Canvas101 or their respective copyright owners, and are used by Canvas101.co.uk pursuant to express authorisation from copyright owners or their agents. You acknowledge that all copyright, trademarks and other intellectual property rights in and relating to Canvas101.co.uk are vested in Canvas101.co.uk or our partners where appropriate. You must not use, reproduce, modify or distribute our images or any part of those images in any manner, whatsoever. In the event that there is any dispute between us in relation to this issue, you agree that until the matter is resolved, an interim injunction will be an appropriate remedy. An Interim injunction is a court order, which would prevent any further use or distribution of the image that we are concerned about, until a final court hearing where the court will make a decision on all the facts. We assume that you hold any and all neccessary licences/copyright/permissions to print any image recieved for "your photo on" products.  

 


 

7. Loss

Please be aware that we will not be liable to you or any third party for any indirect or loss or damage, or for any loss of data, profit, revenue, business or management time, howsoever caused.
You also agree that the liability of Canvas101.co.uk under this agreement (whether arising in negligence or otherwise), will not under any circumstances exceed the greater of a) £500 or b) an amount equal to the sums paid or payable by you. This does not affect your statutory rights as a consumer.

 


 

8. Fraudulent Claims

All customers are warned not to make Fraudulent claims against Consortium101 Limited / Canvas101.co.uk. We invest a lot of time and money into ensuring all customers receive their goods in A1 condition. All art work will be sent via our network of couriers, “INTERPARCEL EXPRESS”. Please note all parcel will need to be signed for upon delivery. We advice all customers to check parcels on delivery for any damage to the box or content. If you are unable to check your box, please clearly state on the driver’s document and sign as UNCHECKED. All parcels will be provided with a tracker number which will allow buyer to track their artwork at every stage of the delivery process. Real time signature will also be available within minutes of customers signing for goods. Real time signatures can be checked online via Canvas101.co.uk, to confirm receipt of goods.

8.1 In the event of consequential loss, Canvas101.co.uk can only be responsible for the cost of your order.

 


 

9. Negligence

We thought we should state that nothing in this agreement limits Canvas101’s liability for personal injury or death resulting from our negligence.

 


 

10. Reasonable Control

Canvas101.co.uk shall not be liable for any failure to perform its obligations under this agreement if caused by matters beyond our reasonable control. Without limiting ourselves here in any way.

 


 

11. Changes to this Agreement

Canvas101.co.uk reserves the right to change the terms of this agreement from time to time, and post a new version on our website. The new version will take effect from the day of posting on the site. Price and availability information are also subject to change without prior notice.

 


 

12. Severability

In the event that any term of this agreement is held to be unenforceable or invalid by judicial decree or decision, the remainder of this agreement shall remain valid and enforceable.

 


 

13. Terms and Conditions - Security and Privacy

We know you're concerned about security and privacy. We want to reassure you that any information you give us during the registration or ordering process as well as any that we know about you by other means will be well protected. We also feel it is important that you know exactly how any information you give us is used and that all information is collected lawfully and in accordance with the Data Protection Act 1998.

13.1 The privacy policy forms part of the agreement between us, and by purchasing goods from our site, you agree to be bound by the terms and conditions of the agreement between us. You also give your consent to the way we may handle your personal data in the way stated in this policy statement. Canvas101.co.uk will not use this data, or disclose it to any other party, either during registration or at any other time, without your express permission, given during registration or at some other time.
We may also contact you in respect of special offers or competitions, but only if you have elected to receive this by checking the opt-in box during the registration procedure. You may unsubscribe from our contact list at any time by replying to a promotional email with the word "unsubscribe" in the subject line, by e-mailing us at info@canvas101.co.uk

To provide a service that meets our customer needs, we may collect personal data relating to the popularity and usage of particular aspects of the site or related Canvas101.co.uk sites. However this data will be used or aggregated only on an anonymous basis.

 


 

14. How we protect your data

Any credit card information you give us will be held at a secure and separate site, and once we have authorised your purchase, we will delete part of the number and details, so that even in the highly unlikely event that our site security was breached for any reason your credit card details would be unusable.

 


 

15. Description and price of the goods

15.1 The description and price of the art you order will be displayed on the Canvas101 site. If you need further assistants with any art description please contact info@canvas101.co.uk or call us on 0207 183 2903

15.2 All artwork ordered is subject to a generic 7 day turnaround period, although most of our artwork leaves our studio well before the stated time. If for some reason the artwork you order is no longer available or a problem arises you will contacted with 3 days and receive a full refund. Please note from time to time we run promotional shipping offers where we ship goods within 24-48hrs. Please note that these are promotional time frames and do not form a contract between ourselves and you.

15.3 Every effort is made to ensure that prices shown on the Canvas101 website are accurate at the time you place your order. If an error is found within 14 days of accepting your order, the Supplier will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order. If the Supplier does not receive an order confirmation within 14 days of informing you of the error, the order will be cancelled automatically. If you cancel the order, or if the order is cancelled automatically due to the expiry of the 14 day period, the Supplier will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.

15.4 In addition to the price of all artwork, you will be required to pay additional shipping costs which will be stated on the canvas101 website. Free shipping is only available if stated within product description at time of order.

15.5 Unless a PDF proof option has been purchased you grant Canvas101 the right to make changes to any aspect of the order, including but not limited to size, proportions, print media, print method, etc. This means that without prior contact Canvas101 can use their discretion, should it be required to alter aspects of the order and artwork such as size, bleed type, cropping, etc should the artwork not match the product selected.

17. Refund & Cancellation Policy

17.1 Here at Canvas 101 we want all our customers to be happy with the purchase they are making, that is why we offer a 7 day money back guarantee, excluding the cost of postage. If you are not totally satisfied with your purchase you may return it to us within 7 day of receipt in its original package. All returned goods will inspected by our returns department and refunds issued within 3-5 days from receipt of goods. Please note all returned goods are subject to a 25% handling charge. When purchasing from Canvas101 you agree to these terms and conditions.

17.2 If you wish to cancel an order you must contact canvas101 within 24 hours of placing the order. Orders cannot be cancelled after the initial 24 hour stage as your order will be in the manufacturing stages. Once orders have been sent through to production no cancellations can be made.

17.3 Customers are advised that refunds are not offered on the following services as these are not re saleable goods; Your photo on Canvas, Your Photo on MDF block Mounts, Designer effects on canvas, Your photos on foam board, photos on Perspex and Photo montages. Unless your purchase on any of the above services is from our gallery range we do not offer any kind of refund unless your goods are physically damaged upon delivery on which case we ask you not to sign for them. Any claims believed to be fraudulent will be dismissed immediately and no refunds or exchanges offered.

 


 

18. Shipping Policy

18.1 All artwork will be securely wrapped in our custom built art boxes. Unless otherwise specified all artwork is sent either via, Interlink Express, DHL, FedEX or Royal mail on a next day delivery. Please not artwork can take up to 7 days to produce after placing your order, although we often deliver well within in this time. The next day delivery does not mean your artwork will arrive the day after placing the order. All packages will need to be signed for upon delivery. Buyer will be provided with parcel tracking information upon request. All prices quoted are for the desired location listed. If for some reason you wish to order from a destination that we do not deliver to please contact us to see if arrangements for delivery can be made.

18.2 If you are ordering outside the UK, canvas 101 will not be held responsible for any Import or Customs Taxes you may incur.

 18.3 All customers are reminded that our couriers attempt to deliver goods to you on three separate occasions; this means if you miss the delivery the first time round the courier will attempt to deliver again a total of three times. Each time to courier visits and a failed delivery is made a card will be left, our couriers also note details such as door colours or object around the property to prove on tracking documentation that a visit has been made. If three failed attempts are made goods are sent back to us upon which point you will be charged to have these redelivered to you. Our FREE shipping offer is exempt in these situations. When purchasing from us you agree to these above shipping terms.

 


 

19. Damaged and Lost Goods

19.1 Upon delivery of goods customers are reminded that they must inspect the packaging for any signs of serious damage, if you spot any form of damage on your packaging please sign for your goods as damaged. This protects both yourself and ourselves in the event of a claim against our couriers and a replacement item for yourself.

19.2 If you are reporting a damaged item to us you are required to take the following steps;

- Photograph the damage to the product and email this to support @ canvas101.co.uk please be sure to quote your order number

- Make sure you hold on to the original packaging as this will need to be inspected by our returns department

- Once all the above details have been submitted a member of our team will contact you back with a resolution.

19.3 Canvas101 will not accept any products as damaged after a period of 12 months has elapsed. Customers are reminded to immediately check good upon arrival to ensure items are in satisfactory order. When placing items into storage for use at a later date we offer a grace period of upto 6 months at which point the item must be checked and installed so any defeats or faults can be identified. 

19.4 Canvas101 send most goods via tracked couriers and therefore occurances of lost items are rare. Shoud you suspect your item has been lost or you have not recieved your item within 10 days of the latest delivery date please contact us immediately. If your item has been lost a team member will contact you with a resolution, usually in the form of a replacement item being sent, however we may at our discretion opt to refund the item.
